there was no use legal arguments (with that line of thought at least). i used to words "legal incompetents," but it was only for humorous purposes. basically, i intended for non-law folks to giggle just a little bit at the silliness of it all - in real-world common sense terms.
i.e. a minor (considered legally incompetent to enter into most contracts) can enter into a lifetime contract with someone of the opposite sex, yet a fully functioning adult with sound mind cannot enter into a lifetime contract of the same sex.
see? absurd in non-law real world terms.
she didn't make the argument to take away rights. she was making an argument for extending them to people who are currently excluded from them.
or... if the state believes children can make this type of decision but disallow (some) grown adults from making the same decision, it is allowing a "weird" thing to happen but disallowing a normal thing to happen.
