You and Pyra agree to submit to the personal and exclusive jurisdiction of the courts located within the county of San Francisco, California.this only deals with the relationship between a user and blogger/pyra/google, but if you use blogspot, you're getting hosted by servers in california. california is a logical place for someone to take you to court if you make someone mad. (well they can take you to court pretty much anywhere, because blogger directed its service nationwide and has users from all over the united states, but as you will see, if you make someone mad by posting something - like something secret for example - it is best to be sued in california. or at least the san jose district. and san francisco, i believe, would jump on the bandwagon in a second.)
the sixth district court of appeals in california (san jose) ruled on friday that bloggers are journalists and may be shielded from divulging their sources pursuant to the california reporter shield law. google "apple" and "blogger" and find the case/story for yourself.
big day for bloggers.
*note, if you find the case on westlaw (citation: 2006 WL 1452685) on on findlaw, take note that the court cites WIKIPEDIA. that's right. a source that anyone in the world can edit, anytime - and whose articles have the life span of a fart. i don't know how the law clerks got away with that. download the case, find the citations, and then log onto wikipedia and change the articles around just for fun. because you can!
