i'm too lazy to look it up, but i'm guessing that california would be a state which might have sexual orientation as a protected class in its human rights bill (new york does). if so, i wonder why her lawyers chose not to argue disparate treatment / equal protection as well. it seems to be a stronger argument than privacy.
